<p>Spinal cord injuries may result from traumatic damage to a person's spine that affects the nerve fibers that allow the body to function.  For example, an injury to the lower back can affect nerves controlling the abdomen, legs, bowel and bladder. A severe neck injury can affect arm and hand movement.         <![CDATA[<p>As in all states, in California, the parties to a divorce may negotiate their own arrangement as to property division outside of court. However, coming to an agreement is not always possible - and even when couples can find common ground, the standards a court would use to divide property if it ultimately had to do so underlie negotiations.</p>

<p>California is a community property state. Generally speaking, this means that all property/income acquired during the marriage is subject to a 50-50 division upon <a href="/Divorce/">divorce</a>. Any property acquired before the marriage or property acquired by either party in certain ways, such as by gift or inheritance, is excluded from division.</p>

<p>Parties to a divorce and their lawyers may present evidence that shows how a particular piece of property belongs exclusively to one spouse or another, or argue as to why property should be divided in a certain way. Yet, that 50-50 split set forth by California law is always a baseline for negotiations and courtroom arguments.</p>

<p>For some couples, a legal separation may be a better idea financially. Religious or personal reasons are often behind long-term legal separations. But significant property benefits may also make separation a worthwhile solution.</p>]]>
        <![CDATA[<p>So why can legal separation be a good idea financially? Primarily, separated spouses may still share in certain benefits. Healthcare coverage offered by one spouse's employer, certain military benefits and filing a joint tax return are just some of the financial incentives to remaining married. For some couples, a legal separation is also a temporary solution to getting the Social Security benefits that can come with marriages that last at least 10 years. And, spouses who separate but remain married can still pool some household resources.</p>

<p>While a legal separation is often fruitful, it also warrants caution. If spouses act as though they are divorced when they remain technically married, problems can ensue - for instance, separated spouses remain liable for each other's debts. To address such potential pitfalls, anyone living apart from their spouse should consider a legal separation agreement. Separation agreements are legally binding documents that pertain to matters like the division of property and debt, spousal support and child custody issues.</p>

<p>Sometime divorce is tough financially. But, by devoting attention to possible value-creating alternatives like legal separation, your pocketbook can come out well in the black.</p>

        <![CDATA[<p>We all know who loses in a motorcycle crash with a large vehicle. A biker's body without the protection of the larger vehicle's steel casing in a high speed collision with a car - let alone a truck - doesn't have much of a chance of escaping injury.</p>

<p>Of course motorcyclists can decrease their chances of <a href="http://www.rooneylawfirm.com/Personal-Injury/Motorcycle-Accidents.shtml">motorcycle accidents</a> and increase their safety odds by wearing helmets, goggles and protective clothing; never drinking alcohol or ingesting drugs before biking; following the rules of the road; and taking dangerous conditions into account.</p>

<p>But car and truck drivers have the responsibility - legally and ethically - to handle themselves on the road in a manner more likely to keep bikers safe. Not only will there be legal consequences to harming a motorcyclist by negligent or illegal driving moves, but the personal anguish of severely harming or killing another person when it could have been avoided may be unbearable.</p>]]>
        <![CDATA[<p>In fact, fatal car or truck collisions with motorcycles are more often the motorists' fault than the riders', according to the Motorcycle Safety Foundation.</p>

<p>Some solid safety suggestions for drivers when they meet motorcycles in traffic:</p>

	<li>Don't follow a cycle as closely as you might a car or truck. Bikes can't stop as quickly in wet conditions and the way bikers slow down may not always activate brake lights.</li>
	<li>Be aware that motorcycle turn signals need to be manually turned off, so it is more likely that a biker may leave a signal on unintentionally. </li>
	<li>Try to increase your awareness of the possible presence of motorcycles in the traffic flow. They can easily fall into blind spots or be hidden by other objects.</li>
	<li>Assume a motorcycle is closer than it looks, and that it is going faster than it appears to be.</li>
</ul>

<p>A little bit of old-fashioned civility and courtesy on the road will go a long way toward increasing biker safety.</p>]]>

<p>Recalling the successful "Click It or Ticket" seat-belt awareness programs, NHTSA launched the media campaign "Phone in One Hand, Ticket in the Other," in cities in New York and Connecticut. By actively observing cell phone use and monitoring public awareness before and after the campaign, NHTSA researchers concluded that cell phone and texting use by drivers fell by one-third in one city and over one half in the other.</p>

<p>"Based on these results, it is crystal clear that those who try to minimize this dangerous behavior are making a serious error in judgment, especially when half a million people are injured and thousands more are killed in distracted driving accidents," U.S. Transportation Secretary Ray LaHood said in a NHTSA press release. LaHood emphasized the importance of high visibility law enforcement presence to enforce traffic laws and remind drivers of the criminal consequences.</p>]]>
        <![CDATA[<p>According to NHTSA, distracted driving was involved in nearly 5,500 American car and truck accident fatalities resulted from distracted driving in 2009. Yet more than a dozen states have yet to pass texting bans for all drivers.</p>

<p>California lawmakers have recognized the dangers of distracted driving by passing a handheld phone and texting ban for all drivers, as well as banning all cell phone use by bus drivers and novice drivers.</p>

<p>Regardless of the criminal consequences, drivers are negligent when they allow themselves to be distracted by cell phones or other devices. The new law, authored by San Mateo Assemblyman Jerry Hill, allows California family courts some discretion to grant parental rights to individuals who have an established relationship with a child, even if a biological father has stepped forward with a voluntary declaration of paternity.</p>

<p>The new law allows courts to take into account existing bonds between a child and an individual whom they have recognized as a parent in adoption proceedings. The bill, which has major implications for individuals in same-sex relationships, passed in both the Senate and Assembly with considerable majorities.</p>]]>
        <![CDATA[<p>The central change going forward is how California law will deal with conflicting presumptions with respect to parentage. Prior to passage of the bill, a man was presumed to be the father of a child if he was married to or cohabitating with the biological mother, but parenthood would also be presumed if a man had signed a voluntary declaration of paternity.</p>

<p>The California Family Code now provides that a voluntary declaration of paternity is invalid if the child already had a "presumed parent" at the time the declaration was signed, or if the man signing the declaration is a sperm donor. Presumed parenthood will be based on the court's consideration of a variety of factors, including "the nature, duration, and quality of the petitioning party's relationship with the child" in deciding whether to set aside the voluntary declaration of paternity.</p>]]>

        <![CDATA[<p>A Northern California teen recently earned the inauspicious distinction of being the third student driver to collide with a California Department of Motor Vehicles building in recent years. The teen apparently mistook the gas pedal for the brake and crashed into the side of the Roseville DMV, knocking a five-foot hole in the building's wall and putting the office out of commission for four days.</p>

<p>While this story may seem like something out of an old cartoon, <a href="http://www.rooneylawfirm.com/Car-Accidents/">car accidents</a> caused by inexperienced drivers are no laughing matter.</p>

<p>Immaturity and inexperience can be a dangerous, and all too often deadly, combination for many teens. Car accidents are the leading cause of death for American teenagers, who suffered 4,054 accident-related fatalities in 2008.</p>

<p><strong>Graduated License Programs Do Little to Decrease Risk</strong><strong></strong></p>

<p><strong> </strong></p>

<p>California, like many states, has attempted to curb the rate of teen-driving accidents by implementing a graduated license program for young drivers. Under the program, teens who pass their driving test are issued a provisional license that puts a one-year restriction on operating a motor vehicle between the hours of 11 p.m. and 5 a.m.  Further, drivers under the age of 20 are prohibited from having passengers in the car unless they are supervised by an adult over the age of 25.</p>]]>
        <![CDATA[<p>Unfortunately, a new study published in the Journal of the American Medical Association shows that these programs may not be as effective as anticipated.</p>

<p>The study found that in states with graduated license programs, the rate of fatal accidents involving 16-year-old drivers was 26 percent lower than in states without restrictions on teen drivers. However, the study also found that the graduated license programs were associated with a 12 percent increase in fatal accidents involving 18-year-old drivers - essentially cancelling out the decrease among younger drivers.</p>

<p>Instead of increasing overall safety, the study concluded that graduated license programs may just shift the risk from younger drivers onto older teens.</p>

If adopted, the new rule will require trucks weighing more than 26,000 pounds to install speed-regulating engine controls called electronic control modules (ECMs).</p>

<p>A study being conducted by the U.S. Department of Transportation's Federal Motor Carrier Safety Administration (FMCSA) on the safety and economic impact of truck speed limiters will be reviewed before a change is finalized. If approved, a rule limiting truck speeds will join other proposed regulatory initiatives.</p>

<p><strong>Other Safety Measures Studied</strong></p>

<p>In 2000, large <a href="http://www.rooneylawfirm.com/Personal-Injury/Truck-Accidents.shtml" target="_blank">truck accidents</a> were linked to 5,211 fatalities and 140,000 injuries.  Committed to reducing this toll, the FMCSA is exploring a number of potential safety measures.</p>

<p>In a report to Congress in 2011, the FMCSA indicated research support for the use of event data recorders (EDRs) to reduce crash risks. Once installed, EDRs gather vehicle data including speed, braking and throttle position during truck operation. Analysis of this data helps pinpoint problems and improve driving behavior, thus reducing the risk of a crash.</p>]]>
        <![CDATA[<p><strong>Proposed Speed Change Draws Mixed Reactions </strong></p>

<p><strong> </strong></p>

<p>The latest speed control proposal has drawn mixed support from the trucking industry. The American Trucking Associations (ATA) argued in 2006 that lower truck speeds would reduce the crash severity, cut fuel use, improve highway safety and the environment.</p>

<p>However, smaller truckers, represented by the Owner-Operator Independent Drivers Association (OOIDA) oppose the rule, arguing that limiting speed would inhibit safe travel. "All credible highway research shows that highways are safest when all vehicles travel at the same speed," said Todd Spencer, executive vice president of OOIDA in the Journal of Commerce.</p>

        <![CDATA[<p>The program is usually held at a high school, where the "Grim Reaper" calls out randomly chosen students who are then removed from class. One student is removed every 15 minutes, according to a description of the program on the Every 15 Minutes website. A police officer then enters the classroom to read an obituary that is said to have been written by the deceased students' parents. The program consists of a number of other events, including a mock car accident staged on school grounds, as well as a speaker who tells the story of the actual death of his or her child because of a DUI-related accident, texting while driving, or other type of cause.</p>
<p>The Every 15 Minutes program, which has undoubtedly raised awareness of the issue of drunk driving, and other programs seeking to curb drunk driving, must have had some measure of impact.</p>
<p>A recent tragic car accident in Glenn that resulted in the death of three people, some of whom had just graduated from Willows High School, may cause postponement or cancellation of the event at that high school. It remains to be seen whether there was alcohol involved - there are reports that the driver who crossed the center line may have had a small amount of methamphetamine in his car.</p>

<p>According to MedPage Today, a recent study of 40,890 <a href="http://www.rooneylawfirm.com/Personal-Injury/Motorcycle-Accidents.shtml">motorcycle accidents</a>-apparently the largest study of its kind so far-finds that the likelihood of death in a motorcycle accident goes down by 37 percent with a helmet, and the likelihood of traumatic <a href="http://www.rooneylawfirm.com/Personal-Injury/Brain-Injuries.shtml">brain injury</a> goes down by a whopping 65 percent.</p>]]>
        <![CDATA[<p>But if you believe those who oppose mandatory helmet laws, who argue that helmets impair a rider's vision and actually increase the risk of spine injury due to torque on the head in a collision, then wearing a helmet is not all it's cracked up to be.</p>
<p>The principal doctor involved in the study seems to believe otherwise.</p>
<p>Joseph G. Crompton, MD, of UCLA, said, "This analysis of the largest trauma database ever assembled demonstrates that injured motorcycle riders are significantly less likely to suffer from a cervical spine injury when wearing a helmet compared with nonhelmeted riders, effectively debunking the myth that motorcycle helmets are associated with higher risk of cervical spine injury after a crash."</p>
<p>Crompton argues that legislators should use the results of the study to influence the passage of mandatory helmet laws, which used to be in effect several decades ago in almost every state in the U.S.</p>
<p>Every rider of any age used to have to wear a helmet.</p>
<p>Now, only 20 states have mandatory helmet laws, despite the very high risk of serious injury or death in a motorcycle accident without a helmet.</p>

Drivers may not see those in crosswalks, leaving the victim defenseless against an oncoming vehicle. In pedestrian crosswalk cases, the pedestrian often takes the full impact of the crash,&nbsp;with very little time to react and avoid the vehicle.</p>
<p>It is not uncommon for these accidents to result in death for the pedestrian. Alex Kirst, former drummer for Iggy Pop, was recently struck and killed as he walked along Date Palm Drive in Cathedral City. Investigators determined that a white Chevy Tahoe or GMC Yukon apparently struck Kirst and fled the scene. There was no evidence that the driver made any attempt to stop before he or she drove into Kirst.</p>]]>
        <![CDATA[<p>Local officials have asked residents to help them find the driver of the SUV. Kirst was the sixth pedestrian to die on valley-area roads in seven weeks.</p>
<p>With the number of pedestrian accidents increasing, reducing the number of accidents has become a top priority for those in the area. Nationally, efforts are underway to make drivers more knowledgeable about the conditions they may be facing when heading out on a trip.</p>
<p>Car manufacturer Audi has recently announced a plan to help make more information available to drivers. The initiative is focusing on improving driver behavior by analyzing the conditions of the route that will be traveled. This information will then be sent to drivers to help them reduce the amount of stress and potential risk of accident.</p>
<p>The plan calls for studies of roadways to learn how they change depending upon the situation. For instance, how do sporting events or accidents change the traffic flow over time? Do these events increase foot traffic? Is there a safer route to avoid rush hour traffic? Where are the trouble spots that should be most concerning to drivers?</p>
<p>Once this information is compiled, it needs to be relayed to drivers in the area. Researchers will be studying the most effective way to pass along the details that will allow drivers to plan the route that is best for them.</p>

        <![CDATA[<p>A multi-million dollar settlement was recently reached in a two-year legal battle following an unfortunate amusement park ride accident in California in 2008.</p>
<p>The Yo-Yo amusement park ride, with chairs that swing passengers round and round above the ground, requires regular and thorough maintenance. The Yo-Yo ride manufacturer, the aptly named Chance Rides, requires the cylinder to be sent back from the owner and rebuilt every five years.</p>
<p>But, in the case of the Yo-Yo ride at the county fair in Angels Camp, California, its owners did nothing to maintain the ride for at least 10 years, exhibiting substantial <a href="http://www.rooneylawfirm.com/Personal-Injury/Property-Owner-Negligence.shtml">property owner negligence</a>.</p>]]>
        <![CDATA[<p>The Wichita Eagle reports that on May 16, 2008, the Yo-Yo ride in Angels Camp collapsed and injured 23 people, most of whom were children. All of the Milligan family's four children were injured on the ride after it collapsed, and were dragged on the ground for one-and-a-half revolutions.</p>
<p>The arms simply fell off when nuts came loose, according to the Wichita Eagle.</p>
<p>The attorney who represented the family said, "Essentially, they sacrificed consumer safety for their own protection." Apparently, it was financial protection, as both the current owner (Midway of Fun) and the prior owner did nothing to maintain the ride since 1997. <br /><br />The settlement involves more than $3.3 million to be paid to the Milligan family; one of the Milligan children has ongoing learning disabilities from severe brain injury as a result of the collapse.</p>
<p>Nine people were injured in a 2006 accident involving the Yo-Yo ride in Texas, prompting Chance Rides to issue a warning, but Midway of Fun apparently ignored that warning when maintaining their own Yo-Yo ride equipment.</p>
<p>Following the Angels Camp accident in 2008, the U.S. Consumer Product Safety Commission recalled 85 Yo-Yo rides.</p>

<p>Take, for instance, driving under the influence of alcohol or drugs.</p>]]>
        <![CDATA[<p>California voters recently defeated Proposition 19, which sought to end marijuana prohibition and allow limited possession and cultivation, by a relatively slight margin of 54 percent. There were myriad reasons to vote for Prop 19 as there were against it.</p>
<p>Those who voted against Prop 19 were likely concerned with driving while high - ending marijuana prohibition would cause an increase in those who purchased and smoked marijuana - and thus lead to greater numbers of marijuana-influenced motorists causing accidents.</p>
<h3>Stoned, Drunk or Texting</h3>
<p>At first glance, driving under the influence of marijuana seems to be just as bad as <a href="http://www.rooneylawfirm.com/Drunk-Driving/"><strong>drunk driving</strong></a> in terms of impairment and risk to safety. After all, good driving requires the full attention of a completely sober motorist - and even undivided attention may not be enough to avoid a car wreck in some cases.</p>
<p>But while marijuana possession remains illegal in California, to many experts it is not clear that driving while high on marijuana is as dangerous as drunk driving - calling into question whether, had Prop 19 passed, legal marijuana would be a direct cause of more accidents.</p>
<p>As Eric Morris writes on the New York Times Freakonomics blog, "Lab work is a better reflection of what people can do than what they actually do," referring to studies showing that drivers high on marijuana tended to drive safer than those who were drunk. Under lab conditions, drivers knew they were being watched.</p>
<p>So, we conclude (as an attorney would) that negligence is negligence. To be stoned, drunk or texting is failing to drive safely.</p>
